Colorado roof claim deadlines: what your insurer has to do, and by when

After a hail or wind loss the insurer is on a clock. We read the Colorado rules (Colorado Division of Insurance Regulation 5-1-14 (3 CCR 702-5) and C.R.S. 10-4-110.8) and put each time limit in one table, with the section number so you can check it. Enter your dates to see the days that matter.

Counted from receipt of a valid and complete claim, which the rule defines as all documents received, the investigation finished and the policy conditions met. It does not apply where there is a reasonable dispute, such as information still missing or an appraisal under way. A good faith offer within 60 days also meets the rule (§4.A.3). After a major catastrophe an insurer may ask the Commissioner for a deviation or exemption (§4.A.8). If an insurer misses the 60 days with no reasonable dispute, the Commissioner may order it to pay 8 percent annual interest on the benefits due (claims over $100).

Why timing matters here: hail in Colorado

What to do in the first week

  1. Photograph the damage and note the storm date. The hail claim checklist lists what to capture.
  2. Report the claim in writing (email or the insurer's portal) and save the date you sent it. That date starts the first clock.
  3. Keep a log of every paper you send. The "last paper" date is what starts the decision clock.
  4. Get a roofing inspection and estimate. Compare the number against the insurer's. Find a Colorado roofer.
