What we could not confirm in Virginia
- No single statewide notice deadline found in the rule text; the SCC consumer guide says policies require 'immediate notice'. Check your policy. Official page.
- Va. Code §38.2-2105 (standard fire policy) refers to suit within two years of the loss, but §38.2-2100 limits that chapter to fire policies and §38.2-2108 lets the SCC set separate content standards for owner-occupied dwelling policies. Not confirmed for homeowners claims; check your policy. Official page.
Not legal advice. Virginia's claim rules (14VAC5-400) bind the insurer; they say nothing about how long you have to report a loss or sue, so that comes from your policy. The state's old fire-policy statute (Va. Code §38.2-2105) mentions two years to sue and a 60-day proof of loss, but it covers fire policies and we could not confirm it governs a homeowners roof claim, so no suit deadline is stated. Check the policy and ask the Bureau of Insurance or a Virginia attorney. Information only. Complaints in Virginia start with the Virginia State Corporation Commission, Bureau of Insurance.
